    ROB, I didn’t mention the Holocaust, but certainly, pre medinah Zionism provoked increased hatred (Chevron massacre). I’m not a baki on the Shittah Hakedosheh; did Zionism cause the Holocaust on a practical level, or on a ruchniyusdik level? Perhaps both?

    There are still levels. Sure they hated us, but Zionism, and then the Medina, further provoked them. We still do things to provoke them, and see a clear reaction. One example which comes to mind is going to Har Habayis (putting aside tumah issues).

    I’m not sure I get you. Are you perhaps unaware of the fact that the reason we’re more meikil by certain dairy products than by milk itself is because it’s not easy to produce them from milk of a b’heimah t’meiah?

    There is no reason to doubt the teshuva. He wrote it. Not being in the I”M means nothing. There’s no stirah to baal nefesh yachmir. He wrote that when it was very difficult to get CY. When it became easier, he wrote tzorich l’hasig. The halacha didn’t change, the circumstances did.

    Rav Dovid may hold differently than his father about tzorich l’hasig. That doesn’t change what Rav Moshe wrote and allowed to be published. Nor does that teshuva make cholov stam assur, it just says explicitly what Rav Moshe held should be done l’maaseh under easier circumstances. ???”?. It makes sense.

    I can say ?”? about anything, really. Maybe Rav Moshe assered cholov stam, and he meant the opposite of what he wrote. ?”?.

    I’m not sure why you would think that a teshuva he wrote, which was printed, just not in the I”M, is less than relevant. Do you have inside knowledge of what the criteria were for being included or excluded? Maybe it was excluded for the simple reason that there was no chiddush there.

    Common sense (and the generally accepted halachic approach) dictates that when something is halachically superior, one should incur a slight loss for it.

    The teshuva to R’ Weinfeld proves that this is the case. The fact that it wasn’t printed in Igros is entirely irrelevant.

    “???? ?????” is actually a bit stronger than what I’m saying.

    There are many levels of sha’as had’chak, ranging from slight inconvenience or increased cost, to choleh. I don’t think R’ Moshe only wanted people to rely in the heter for a sha’as had’chak on the level of choleh where there’s no alternative.

    However, the fact that R’ Moshe intentionally (according to R’ Belsky) made sure to add “baal nefesh yachmir” to every teshuva, plus feels that mosdod hachinuch should be makpid even at great cost, plus, despite his great anavah, writes that he personally was makpid, is a strong indication that where there’s no or little extra cost or inconvenience, he feels one should not rely on the heter.

    The thrust of R’ Moshe’s teshuvos in the Igros point to the heter not being recommended unless it’s sha’as had’chak, the teshuva to R’ Weinfeld merely enforces it, and there could be any number of reasons it wasn’t printed in Igros, but l’maaseh, he wrote it.

    That the heter should only be used b’sha’as had’chak, and that it’s muttar meikar hadin, are not mutually exclusive.

    Here’s the issue as I see it: we have certain benefits from freedoms, but certain risks and disadvantages. Any law which takes away freedom has its upside and its downside.

    The Indiana Law protects our ability to discriminate against what the Torah calls toeivah (or, against people proudly practicing such, if you wish).

    OTOH, it allows others to discriminate against us and claim that their religion wants them to do so.

    Which is a bigger risk/disadvantage/benefit?

    That’s the million dollar question.

    Okay, let’s say he read medical journals. How many people can claim that they can map out a complex surgery which the biggest doctors, with years of schooling and experience, couldn’t do, by just reading medical journals?

    Yekke2, the answer is zeh v’zeh gorem. Which is true whether or not he read medical journals, we would just say zeh v’zeh v’zeh gorem.

    There are many gedolim about whom nobody claims such medical knowledge. What the Shevet Hakevi is telling us is that certain gedolim were able to draw upon their Torah knowledge to develop medical skills, but he doesn’t claim it about every gadol, even of the same or higher level.

    So what makes the difference? It might be their specific mehalach halimud, it might be innate skills, and perhaps they read medical journals (we certainly know that the Chazon Ish didn’t go to medical school).

    Whichever it is, or even if it’s all three, it doesn’t change the fact that they drew upon their Torah knowledge to develop incredible medical skills.

    Is that really why you think – that everything’s merely a test, rather than having actual meaning? That kind if flies in the face of a lot of Chazal and most of Sefer Hachinuch, no?

    Also, have you addressed my chilluk between “should” and “would”?

    There has to be a point at which there’s no more “Why?”, otherwise, ein l’davar sof. I could just as easily ask you “Why should someone do something for his benefit?”, and there no real answer other than to rephrase the question.

    They want to show that we’re backwards because we keep kitniyos even though the reasons applicable in the era when the issur was accepted no longer apply.

    So too, the Torah’s values, which at one time made sense, ch”v no longer apply.
